• Only after a conversation with you, and only if you agree to proceed with our assistance, will your information be shared with relevant lenders from our panel.
• Before any information is passed to a lender, we will confirm with you which lenders are being approached and for what purpose.

We do not sell, rent, trade, or otherwise disclose your personal information to any third party for commercial gain. We do not share your data with marketing agencies, data brokers, or any unrelated organisations.

The only circumstances under which we may disclose your information without prior consent are where we are required to do so by Australian law, a court order, or a regulatory authority.

Third-Party Platform: GoHighLevel (Appointment Booking & Consultation Forms)

Our website uses GoHighLevel — a customer relationship and appointment management platform — to power certain booking and consultation forms, including our Schedule a Call, SME Checklist, and Consultation Request forms.

When you submit information through one of these forms, your data is processed and stored by GoHighLevel on servers located in the United States.

Disclosure under Australian Privacy Principle 8 (Cross-Border Disclosure): By submitting a booking or consultation form on our website, you acknowledge that your personal information may be transferred to and stored in the United States by GoHighLevel. We take reasonable steps to ensure GoHighLevel handles your information in a manner consistent with the APPs; however, once transferred, that data may be subject to US law. You may have rights to access that data directly through GoHighLevel’s Privacy Policy at www.gohighlevel.com/privacy-policy.

GoHighLevel is used solely for scheduling and initial contact management. Information submitted through GoHighLevel is accessible to authorised Probiz Finance staff only and is not shared with any lender or third party without your consent, consistent with Section 5 above.

All other enquiry forms on our website (including general contact and eligibility forms) store data within our own secure WordPress environment using Flamingo and do not transmit data offshore.

6. How We Store and Protect Your Information

Flamingo (General Enquiry Forms)

Enquiry and eligibility forms on our website store data within our WordPress environment using Flamingo. This data remains hosted in Australia. Access is restricted to authorised Probiz Finance staff only.

GoHighLevel (Booking & Consultation Forms)

Data submitted through our booking and consultation forms is stored by GoHighLevel on US-based servers. GoHighLevel maintains SOC 2 Type II certification and implements industry-standard security controls. Further details are available at www.gohighlevel.com/privacy-policy.

General Security Measures

Across all platforms we use, we take reasonable technical and organisational steps to protect your information, including:

• HTTPS encryption across all web pages and form submissions
• Restricted access — only authorised Probiz Finance staff can view form submissions
• Regular review of our data handling and third-party platform practices

While we take all reasonable precautions, no method of transmission over the internet is completely secure. If you have concerns about sharing information online, please contact us directly by phone.

7. How Long We Retain Your Information

We retain personal information for as long as necessary to fulfil the purpose for which it was collected, or as required by law.

• Enquiry form submissions: retained for up to 2 years from the date of submission, or until your matter is resolved, whichever comes first.
• Booking and consultation records via GoHighLevel: subject to GoHighLevel’s own data retention policy, accessible at www.gohighlevel.com/privacy-policy.
• Client engagement records (where a formal engagement has commenced): retained for 7 years in line with Australian financial services record-keeping obligations.
• Information no longer required for any business or legal purpose is securely deleted.

If you would like your information deleted sooner, please contact us using the details in Section 9. We will action your request promptly, subject to any legal obligations we may have to retain certain records. For deletion of data held by GoHighLevel, please also contact us and we will coordinate the request on your behalf.
